12-year-old cyclist crushed incident

Today I watched Lawyer Liu Chen's analysis of the "Only Criminal Means Can Solve the Case of the Death of a 12-Year-Old Boy Riding a Bicycle" (https://xingbianren.cn/post/250.html) and felt that every analysis was good.
But I still want to say, the driver is not solely responsible, there are others involved.
Going back in time
1. If the child shouted to slow down, his father would stop and wait for him.
2. If they rode single file, not side by side.
3. If they followed traffic rules and rode within the appropriate range. And is riding a bike at a speed of 37km/h considered high speed.
4. If the father and son followed the rule of not allowing 12-year-olds to ride on the road.
5. If they didn't participate in this activity, or if the organizers had safety awareness.
6. If the child's father listened to advice.

If, suppose this father and son followed these rules, the driver's family wouldn't have been dragged into this, one person's ignorance causing sadness for two families, and the organizer.
Relevant authorities should not take it lightly, otherwise, there will be similar incidents in the future.
But why do I feel like this father and son are a bit like setting up an accident? Or engaging in fraudulent behavior? (Although it is disrespectful to the deceased, I still want to ask, after all, no one can avoid encountering such fathers and sons or families)
If it's setting up an accident, what should be done? He put himself under the wheels, and the brakes didn't work either,
If it's fraudulent behavior, what should be done? Can't stop him.
